The Turkish Medicines and Medical Devices Agency Publishes the Regulation on Cosmetic Products
The Regulation on Cosmetic Products (“Regulation”) has been published in the Official Gazette, dated May 8, 2023 and numbered 32184.
- The purpose of this Regulation is to establish procedures and principles for the sale of cosmetic products on the market, ensuring a high level of protection for human health.
- The Regulation has been developed in accordance with European Union legislation and takes into account the Regulation (EC) No. 1223/2009 of the European Parliament and of the Council of 30/11/2009 on cosmetic products.
- Cosmetic products may only be sold on the market if a natural or legal person who resides in Turkey is appointed as the responsible person, and that person must comply with the relevant obligations set out in the Regulation.
- The responsible person must keep the product information file for 10 years after the last batch/series of the cosmetic product is placed on the market and make it available electronically or in another format at the indicated address on the label, ready to be submitted upon request of the Agency.
- The product information file must be prepared in Turkish or English.
- Sampling and analysis procedures for cosmetic products must be performed reliably and reproducibly.
- Cosmetic products containing nanomaterials must ensure a high level of protection for human health.
- Texts, names, trademarks, registered trademarks, images, and figurative or other signs implying properties or functions that cosmetic products do not have shall not be used in labeling, placing on the market, promotion, or advertising of cosmetic products.
- This Regulation repeals the Cosmetics Regulation published in the Official Gazette on 23/5/2005 and numbered 25823. Products that have been placed on the market in accordance with the repealed Cosmetics Regulation before the date of entry into force of this Regulation may continue to be sold on the market for 2 years after the entry into force of this Regulation.
The Regulation will come into force 6 months after the date of publication.
