The European Commission Fines Delivery Hero and Glovo a Total of €329 Million for Participating in a Cartel in the Online Food Delivery Sector

The European Commission’s press release dated 2 June 2025 and numbered IP/25/1356 (“Press Release”) regarding the infringement by Delivery Hero and Glovo of EU competition rules has been published on the official website of the European Commission.

According to the Press Release:

  • It has been established by the European Commission that Delivery Hero and Glovo, two major players in the online food delivery sector, engaged in a cartel covering the European Economic Area (“EEA”) from July 2018 to July 2022. The anti-competitive practices included:
    • a mutual agreement not to poach each other’s employees,
    • the exchange of commercially sensitive information,
    • and the allocation of geographic markets to avoid competition.
  • These coordinated practices were facilitated by Delivery Hero’s minority shareholding in Glovo, which allowed for increased alignment of commercial strategies and exchange of sensitive data.
  • It has been concluded that the companies’ conduct constituted a single and continuous infringement of Article 101 of the Treaty on the Functioning of the European Union (“TFEU”) and Article 53 of the EEA Agreement.
  • Both companies have acknowledged their participation in the cartel and agreed to settle the case. In line with the Commission’s 2008 Settlement Notice, a 10% reduction was applied to the fines.

Accordingly, the fines imposed are as follows:

  • Delivery Hero SE: €223,285,000
  • Glovoapp23 SA: €105,732,000

The Commission continues to monitor anti-competitive conduct in digital markets, with particular attention to labour market collusion and cross-ownership between competitors.
