Investigation Conducted by the Turkish Competition Board into a Company Providing Online Sales Platform Services Has Been Concluded
The Turkish Competition Board (“Board”) concluded its investigation into whether an online sales platform violated Article 6 of Law No. 4054 on the Protection of Competition by accepting the commitments submitted by the company.
Within the scope of the investigation, it was examined whether the company had abused its dominant position by using user data obtained within the framework of vehicle listing activities of corporate and individual members in the market for online second-hand vehicle trading services, as well as by leveraging intensive advertising expenditures related to the relevant service and the market power it holds. In addition, practices concerning the combination of non-public user data obtained within the scope of different services were assessed as constituting serious indications of a competition law infringement. In this context, interim measures were imposed during the investigation in order to prevent irreparable harm.
Pursuant to the Turkish Competition Board’s decision dated 25 December 2025 and numbered 25-49/1208-683 the process was concluded as follows:
- The company requested to submit commitments in order to eliminate the competition concerns subject to the investigation. Following the assessment, the final commitments submitted were deemed proportionate to the identified competition issues, suitable to remedy these issues, capable of being implemented within a short period, and effective in practice.
- Commitments relating to the limitation of certain service-related redirections and displays on the online platform, the prevention of the use of non-public user data within the scope of the relevant services, and ensuring a balance between revenues and costs after a certain threshold were found appropriate by the Board.
- Accordingly, it was decided to terminate the investigation pursuant to Article 43 of Law No. 4054 through the acceptance of the commitments.
