Commission finds Apple and Meta in breach of the Digital Markets Act
The European Commission’s press release dated 23 April 2025 and numbered IP/25/1085 (“Press Release”) regarding the infringement by Apple and Meta of their obligations under the Digital Markets Act (“DMA”) has been published on the official website of the European Commission.
According to the Press Release;
- It has been established by the European Commission that Apple failed to allow app developers to direct users to alternative offers through the App Store; this conduct has been found to hinder the effective use of alternative distribution channels and to prevent consumers from being informed about more affordable options.
- It has been concluded that the said practice is in breach of the DMA and a fine of €500 million has been imposed on Apple by the European Commission.
- It has been established that Meta did not provide Facebook and Instagram users with an equivalent advertising service that makes less use of their personal data. The “consent or pay” model applied by the company has been found to undermine users’ ability to freely consent to the processing of their personal data and it has therefore been concluded that the model is in breach of the DMA.
- Accordingly, a fine of €200 million has been imposed on Meta by the European Commission.
- Both companies are required to comply with the decisions adopted by the European Commission within 60 days. Otherwise, it has been stated that additional administrative fines may be imposed.
- The European Commission continues its dialogue with Apple and Meta to ensure the implementation of the decisions and is closely monitoring overall compliance with the DMA.
