The Turkish Competition Authority Imposes an Administrative Fine on Facebook

Meta Platforms, Inc. (Formerly Facebook Inc.), Meta Platforms Ireland Limited (Formerly Facebook Ireland Limited), WhatsApp LLC, and Madoka Turkey Bilişim Hizmetleri Ltd. Şti.'s alleged violation of Article 6 of the Turkish Law on the Protection of Competition Numbered 4054, the investigation carried out pursuant to the decision of the Turkish Competition Board (“Board”) dated 11.01.2021 and numbered 21-02/25-M has been completed.

It has been stated by the Board that Meta Platforms combine the data obtained from Facebook, Whatsapp, and Instagram, and that this activity makes it difficult for rival companies to enter the market.

The Board, which decided that Meta distorted competition, based on the Law on the Protection of Competition Numbered 4054, on the basis of the annual gross income determined by the Board at the end of the 2021 fiscal year, Meta Platforms, Inc. (former title Facebook Inc.), Meta Platforms Ireland Limited (former title Facebook Ireland Limited) and WhatsApp LLC, jointly and severally, with an administrative fine of 346,717.193,40 TL.

In addition, it has been decided by a majority vote for Facebook;

  • To submit the necessary measures to the Turkish Competition Authority, within 1 (one) month at the latest, from the notification of the reasoned decision, in order to end the violation specified in subparagraph (c) and to ensure effective competition in the market,
  • To fulfill the necessary measures within 6 (six) months from the notification of the reasoned decision,
  • To submit a report to the Turkish Competition Authority periodically for 5 (five) years from the implementation of the first harmonization measure.
