The Communiqué on the Fee Tariff to be Implemented by the Turkish Patent and Trademark Office in 2025 (BİK/TÜRKPATENT: 2025/1) Is Amended
The Communiqué (BİK/TÜRKPATENT: 2025/2) (“Communiqué”) prepared by the Turkish Patent and Trademark Office (“TPTO”) amending the Communiqué on the Fee Tariff to be Implemented by the Turkish Patent and Trademark Office in 2025 (BİK/TÜRKPATENT: 2025/1), was published in the Official Gazette dated 15 March 2025 and numbered 32842.
According to the Communiqué;
- The trademark renewal fee for trademarks whose protection period has expired is determined on a class-based basis.
- The fee for a request for revocation of a trademark is calculated to be collected in a single payment under two components: (i) the revocation request fee and (ii) the security deposit for the revocation request.
- If the request is entirely rejected, the amount held in the security deposit shall be reimbursed to the registered proprietor upon request.
- If the request is entirely accepted, the security deposit shall be reimbursed to the requesting party upon request.
- In cases where the revocation request is partially accepted, no reimbursement shall be made to either party, and the amount held in the security deposit shall be recorded as revenue by the Office. In order for a reimbursement to be requested, a final decision must have been rendered by the Office.
