NEW REGULATION ON PERSONAL HEALTH DATA IN FORCE

New regulation delegating health data within the framework of Data Protection Law Numbered 6698 came into force through publication in the Official Gazette dated 21.06.2019 and numbered 30808.

The regulation is focused on processing of health data by private and legal entities regarding Ministry of Health’s procedures and applications. The regulation covers important implications such as “Obtaining Health Data of Child”, “Rectification, Erasure and Portability of Health Data” and “Processing of Health Data for Scientific Purposes”.

The regulation also allows some formerly undefined terms such as open data and pseudonymization to get clearence. Additionally, it stipulates for lawyers to obtain clients health data on their behalf, there must be clear and informed consent of the client/data subject stated in the letter of attorney.

This regulation can be considered as a positive step towards full complience with the European Data Protection Regulation which is also known as GDPR.
