MANAGEMENT COMPANY FINED £ 250,000 FOR NUISANCE CALLS

The United Kingdom Information Commissioner’s Office (“ICO”) has fined Reliance Advisory Limited (“RAL”) £250,000 for breaking electronic marketing law.

The ICO found that in the six months since the beginning of 2019, RAL has made 15.1 million calls for claims management services. Although 1.1 million of the calls made were linked to each other, all of the calls were made to people who did not consent to the calls.

85 different complaints were received for the calls made insistently to the ICO and it was stated that the callers behaved aggressively and rude in the complaints.

During the ICO’s investigation, RAL were unable to provide evidence of consent for the majority of calls it made. Where it did provide evidence, for data that it had purchased in the previous 30 days, the consent was found to have not been freely given, specific or informed. RAL also argued that it was not aware of its responsibilities under the law. RAL argued that it was not aware of its obligations regarding all these.
