REGULATION ON PERSONAL DATA IN ELECTRONIC COMMUNICATION SECTOR COMES INTO FORCE

“Regulation on Processing of Personal Data and Protection of Privacy in Electronic Communication Sector” (“Regulation”) was published in the Official Gazette dated 04.12.2020 and numbered 31324.
The Regulation is to determine procedures and principles regarding processing of personal data and protection of privacy in the electronic communication sector in order to ensure protection of the rights of privacy and the fundamental rights and freedom. The Regulation covers the principles and procedures which the operators carrying out business in the electronic communication sector follow in respect to the data obtained by them for providing service.
In the Regulation, the details on the principles for personal data processing, the conditions for obtaining consent, notification of breach, measures for protection of data are provided. For the administrative fines and other sanctions, “the Regulation on the Administrative Sanctions of Information and Communication Technologies Authority” published in the Official Gazette dated 15.02.2014 and numbered 28914 shall be applied.
