POLISH DPA IMPOSES 100 000 PLN FINE ON THE SURVEYOR GENERAL OF POLAND

The Surveyor General of Poland (“GGK”) has faced with 100 000 PLN fine imposed by the Polish Data Protection Authority (“DPA”) due to sharing personal data of the land and property registers without a legal basis. In the present case, GGK has processed personal data unlawfully and has made them intentionally available on the GEOPORTAL2. The inspection was carried out in March 2020 by the president of the Polish data Protection Authority (“UODO”).
As a result of the investigation it is found that personal data were made available in the form of land register numbers on GEOPORTAL2 without a legal basis so that such action results in infringement of Article 5(1)(a) and Article 6(1) of the GDPR. It is also noted in the decision that the shared personal information includes names, surnames, identification numbers, addresses.
As known, according to the article 5(1)(a) personal data must be processed lawfully, fairly and in a transparent manner in relation to the data subject. The data is processed lawfully only in cases where at least one of the conditions indicated in Art. 6 GDPR is met.
