IRISH DPA SHARES GUIDANCE ON TRANSFER OF PERSONAL DATA FROM IRELAND TO THE UK

The Irish Data Protection Authority has published a guidance on Transfers of Personal Data from Ireland to the UK at the end of the Transition Period.

In the guidance, a non-exhaustive list of examples of ways for Irish companies to use when they transfer data to a UK-Based company is provided. It is reminded that the companies will need to put extra measures in place to legally transfer this data before the Transition Period ends.

Also, the guidance takes place the impact of the Judgment of the Court of Justice of the European Union (CJEU) in respect of Case C-311/18 – Data Protection Commissioner v Facebook Ireland Ltd and Maximillian Schrems. As known, in the judgment in that case, it is noted that it is the responsibility of the data exporter and the data importer to assess whether the level of protection required by EU law is respected in the third country concerned.

Lastly, while Standard Contractual Clauses are not an end in themselves, care is required to ensure that personal data is at all times protected to the level contemplated by the GDPR.
