BELGIAN DPA IMPOSED FINE ON AN ASSOCIATION SENDING MESSAGES FOR FUNDRAISING

The Belgian Data Protection Authority (“DPA”) has recently imposed a fine of 1,000 EUR on an association on the ground that the association infringed the article 6.1, 21.3 and 21.4 of the General Data Protection Regulation (“GDPR”).
At the end of the investigation following a compliant lodged by a former donor of the association due to unfulfillment of the article 21.3 and 21.4 of the GDPR, the Litigation Chamber found that the association did not comply with the data erasure request and the data subject's right to object. As known, where the data subject objects to processing for direct marketing purposes, the personal data shall no longer be processed for such purposes (art. 21.3 of the GDPR)
Moreover, it is stated that there were doubts as to whether the data subject could reasonably expect his data to be processed for direct marketing purposes years after the collection of these data.
In this context, the association has been fined of 1000 EUR in consequence of violation article 6.1, 21.3 and 21.4 of the GDPR, by the Belgian DPA.
