Turkish Personal Data Protection Authority Signs Cooperation and Information Sharing Protocol with Competition Authority

On 26.10.2023, the Personal Data Protection Authority announced on its official website that it signed a Cooperation and Information Sharing Protocol ("Protocol") with the Competition Authority.

The processing of personal data is of great importance for today's competition law. It is a factor that seriously affects competition, especially in an era of digital economy and rapid development of technology. Such a serious situation has necessitated cooperation between the authorities. Therefore, in order to ensure an effective regulatory environment, a Cooperation and Information Sharing Protocol was signed between the Personal Data Protection Authority and the Competition Authority.

The Protocol aims to achieve the following objectives;

  • To carry out joint studies in emerging areas that fall within the jurisdiction of both authorities and that may cause irreparable damage in the absence of rapid and effective intervention,
  • To publish reports with the cooperation of both institutions in order to raise awareness among users in terms of the protection of personal data and competition, especially in digital markets, and to convey a common message to undertakings in terms of practices that concern both areas of law,
  • Organizing joint presentation and discussion programs within the scope of the traditional "Wednesday Seminars" of the Personal Data Protection Authority and/or "Thursday Conferences" of the Competition Authority,
  • Organizing trainings where relevant authorities share their expertise and experience in their areas of responsibility,
  • Consulting on common issues at national and/or international events organized and/or attended by the relevant authorities, and supporting these events on issues that fall within the authorities' own areas.

In terms of competition law, personal data is very important due to market dominance and data breaches that have the potential to distort competition. The protocol aims to establish a fair competition environment in the sector.
