Swedish SA (IMY) Fines H&M for Making It Difficult to Avoid Marketing

The Sweden SA (IMY) imposed an administrative fine (“Decision”) on H&M on 17 November 2023 for making it difficult to avoid marketing.

The IMY has started an audit of H&M due to six complaints from people who objected to receiving direct marketing services from the company. The complaints came from people in Poland and Italy but were forwarded to the IMY because H&M is headquartered in Sweden.

In its judgment;

  • The IMY states that H&M breached the GDPR by failing to stop using the complainants' personal data for direct marketing purposes without undue delay, despite the complainants' objections. The decision states that the company did not have adequate systems and routines in place to facilitate complainants to exercise their right to object to direct marketing.

The IMY fined the company SEK 350,000 (approx. EUR 28,500) for violations of the GDPR.
