Guidelines 05/2022 on the Use of Facial Recognition Technology in the Area of Law Enforcement

On May 17, 2023, the European Data Protection Board (“EDPB”) published "Guideline 05/2022 on the use of facial recognition technology in the field of law enforcement".

After engaging in public consultation, the European Data Protection Board has approved a final version of its Guidelines concerning the utilization of facial recognition technology in law enforcement.

These guidelines aim to provide direction to EU and national legislators and law enforcement agencies regarding the implementation and utilization of facial recognition systems.

The guidelines emphasize that facial recognition tools should only be employed in strict adherence to the Law Enforcement Directive (“LED”).

Additionally, their usage should be limited to necessary and proportionate situations, as outlined in the Charter of Fundamental Rights. Within the guidelines, the EDPB reiterates its recommendation for prohibiting the use of facial recognition technology in specific cases, as previously stated in the joint opinion of the EDPB and the European Data Protection Supervisor (“EDPS”) regarding the proposed Artificial Intelligence Act.
