French SA Imposes a Penalty Payment on CLEARVIEW AI

On May 11, 2023, the European Data Protection Board ("EDPB") published a press release that the French Supervisory Authority ("SA/CNIL") imposed a penalty payment on Clearview AI.

Clearview AI gathers photographs from various websites, including social networks, and offers access to its database of people's images through a search engine that allows individuals to be searched using a photo. This service is provided to law enforcement agencies. The search engine utilizes facial recognition technology to find individuals based on their photographs.

On October 17, 2022, the restricted committee of the French SA responsible for imposing penalties fined Clearview AI 20 million Euros.

They also ordered the company to cease collecting and processing data on individuals in France without a legal basis and to delete the data of these individuals after receiving access requests.

Clearview AI was given two months to comply with the order and provide evidence of compliance with the French SA. However, the company failed to provide any proof of compliance within the given timeframe.

On April 13, 2023, the French SA's restricted committee determined that Clearview AI had not followed the order, leading to an additional penalty payment of 5,200,000 Euros being imposed on the company for non-compliance.
