European Union Artificial Intelligence Regulation Published in the Official Journal of the European Union
The European Union ("EU") Artificial Intelligence Regulation ("Regulation") has been published today (12.07.2024) in the Official Journal of the European Union ("Journal"). The Regulation aims to provide a comprehensive framework for the regulation of artificial intelligence ("AI") systems within the EU. The main objectives of the Regulation are as follows:
- Legal Framework for AI Systems: To establish a uniform legal framework for the development, market placement, provision, and use of AI systems within the EU.
- Improvement of the Internal Market: To enhance the functioning of the internal market and facilitate the free movement of AI systems.
- Human-Centered and Reliable AI: To promote the adoption of human-centered and reliable artificial intelligence.
- Protection of Fundamental Rights: To ensure a high level of protection for values such as health, safety, and fundamental rights as outlined in the Charter of Fundamental Rights of the European Union ("Charter").
- Protection from Harmful Effects: To safeguard against the harmful effects of AI systems.
- Support for Innovation: To support and encourage innovation.
This Regulation prevents Member States from imposing their own restrictions on the development, marketing, and use of AI systems, except where explicitly authorized by this Regulation.
The Regulation includes:
- Uniform Rules: Rules for the market placement, provision, and use of AI systems in the EU.
- Prohibitions: Provisions for the prohibition of certain AI applications.
- High-Risk AI Systems: Specific requirements and obligations for operators of high-risk AI systems.
- Transparency Rules: Uniform transparency requirements for certain AI systems.
- General Purpose AI Models: Uniform rules for the market introduction of general-purpose AI models.
- Market Surveillance and Governance: Rules for market surveillance, oversight, governance, and enforcement.
- Support for Innovation: Measures focused on supporting innovation, particularly for SMEs and start-ups.
The EU Artificial Intelligence Regulation will come into effect progressively 21 days from its publication.
