European Commission Opens Formal Proceedings against TikTok over Election Risks under the Digital Services Act

The European Commission (“Commission”) has opened formal proceedings against TikTok on 17 December 2024 for a suspected breach of the Digital Services Act (“DSA”) concerning its obligation to properly assess and mitigate systemic risks related to election integrity, notably in the context of the recent Romanian presidential elections on 24 November.

  • The formal proceedings will focus on the management of risks related to elections and civic discourse. As part of the formal proceedings, TikTok's recommender systems and its policies on political advertisements and paid-for political content will be examined.
  • If the Commission's suspicions are confirmed these shortcomings would constitute infringements of Articles 34(1), 34(2), and 35(1) of the DSA.
