ICO IMPOSES A FINE ON A COMPANY SENDING MARKETING TEXTS ABOUT HAND SANITISING PRODUCT

The Information Commissioner’s Office (“ICO”) has imposed a fine of £ 60.000 on Digital Growth Experts Limited (“DGEL”) on the ground that the company sent thousands of nuisance marketing texts at the height of the pandemic.

In the case, DGEL seeking to profit from the pandemic sent texts of around 16,190 without consent, promoting a hand sanitising product that it claimed to be “effective against coronavirus”.

Throughout the ICO’s investigation, DGEL was unclear and inconsistent in its responses, and it was unable to provide sufficient evidence that it had the consent it is required to have under the Privacy and Electronic Communications Regulations 2003. 

In this context, the DGEL has been fined of £60.000 and ordered to comply with the Regulation within 30 days.
