THE TURKISH DATA PROTECTION AUTHORITY FINES FACEBOOK 1.650.000 TURKISH LIRAS

Last week, the Turkish Data Protection Authority (“Kişisel Verileri Koruma Kurumu”,“KVKK”) announced that it fined Facebook 1.650.000 Turkish Liras. It was the first time that KVKK issued a fine to an international company which does not reside in Turkey.

In 2018, Facebook announced that a data breach occurred due to a Photo API bug (you can find more information regarding software bug here.). Facebook Director of Engineering, Thomas Bar, expressed that 6.8 million users might have been affected by the breach.

Upon this announcement, the Turkish Data Protection Authority investigated the issue on a deeper level to detect whether Turkish users were subjected to the such breach. In the press release on 10.05.2019, KVKK stated that more than 300.000 users in Turkey might have been affected. Thus, KVKK declared that due to “(i)failure to meet data protection liabilities (ii) failure of notifying the authority on time of such breach” under Turkish Data Protection Legislation, they imposed approximately $270.000 fine on Facebook.
