TWITTER COULD FACE ITS FIRST GDPR PENALTY WITHIN DAYS

The European Data Protection Board (“EDPB”) announced on Tuesday it has adopted the two-thirds majority of its members its first dispute resolution decision on the basis of Art. 65 General Data Protection Regulation (“GDPR”) on a draft decision issued by the Ireland’s Data Protection Commission (“DPC”) regarding Twitter International Company and the subsequent relevant and reasoned objections expressed by a number of concerned supervisory authorities.

Last year, Twitter disclosed the bug in its “Protect your tweets” feature - saying at the time that some Android users who had applied its setting to make their tweets non-public may have had their data exposed to the public Internet since as far back as 2014.

According to new data protection regulations, this 2014-2019 breach falls under the EU’s GDPR.

On 9 November 2020, the EDPB said it adopted its binding decision and will shortly notify it formally to the Irish SA. Also, the EDBP stated that the DPC shall adopt its final decision on the basis of the EDPB decision, which will be addressed to the controller, without undue delay and at the latest one month after the EDPB has notified its decision.
