KVKK DECISION: ASSOCIATION, FOUNDATION AND TRADE UNIONS IN TURKEY AS DATA CONTROLLER ARE EXEMPTED TO REGISTER VERBIS !

The Personal Data Protection Board (“KVKK”) has just published its decision numbered 2020/315, dated 22.04.2020 on the website.
In this context, the phrase stipulated for the exemption to register “the Data Controllers’ Registry”(“VERBIS”) in article 3 of the decision numbered 2018/32, dated 02.04.2018 that “ Only associations which are established pursuant to the Law of Associations No. 5253 of 04/11/2004, foundations which are established pursuant to the Law of Foundations No. 5737 of 20/02/2008 and trade unions which are established pursuant to the Law on Trade Unions and Collective Labor Agreements No. 6356 of 18/10/2012 which process personal data that are in compliance with relevant legislation and purposes, limited to its field of activity and towards their employees, members and donators” has been changed as follows; “only association, foundation and trade unions located in Turkey which process personal data that are in compliance with relevant legislation and purposes, limited to its field of activity”.
In this sense, association, foundation and trade unions in Turkey are exempted to register “the Data Controllers’ Registry” under this decision.
