THE POLISH DPA IMPOSES FINE ON EAST POWER COMPANY FOR FAILING TO PROVIDE ACCESS TO PERSONAL DATA

The Polish Personal Data Protection Office (“UODO”) imposed a fine of PLN 15.000 on East Power company on the ground that the company failed to o provide the supervisory authority with access to personal data and other information necessary for the performance of its tasks.

In the present case, upon a complaint against East Power company, UODO sent three requests to the company to submit explanations. However, while two of these requests remained unanswered, explanations for another request were incomplete and contradictory.

In this sense, the President of the Personal Data Protection Office considered that the company intentionally impedes the course of proceedings or at least ignores its obligations related to cooperation with the supervisory authority so that the company does not fulfil the obligation, provided under the GDPR, to provide the supervisory authority with access to personal data and other information necessary for the performance of its tasks.
