EUROPEAN COMMISSION ISSUES PROPOSAL FOR A REGULATION ON EUROPEAN DATA GOVERNANCE

On 25.11.2020, the European Commission has issued proposal for a Regulation on European data governance (“Data Governance Act”) which is the first of a set of measures announced in the 2020 European strategy for data.

The Proposal is to aim to foster the availability of data for use by increasing trust in data intermediaries and by strengthening data-sharing mechanisms across the EU. In the proposal, the following issues are addressed;

  • Making public sector data available for re-use, in situations where such data is subject to rights of others,
  • Sharing of data among businesses, against remuneration in any form,
  • Allowing personal data to be used with the help of a ‘personal data-sharing intermediary’, designed to help individuals exercise their rights under the General Data Protection Regulation,
  • Allowing data use on altruistic grounds.

The Proposal applies to data held by public sector bodies which are protected on grounds of; (i) commercial confidentiality, (ii) statistical confidentiality, (iii) protection of intellectual property rights of third parties, (iv) protection of personal data. Also, agreements or other practices pertaining to the re-use of data held by public sector which grant exclusive rights or which have as their object or effect to grant such exclusive rights or to restrict the availability of data for re-use by entities other than the parties to such agreements or other practices shall be prohibited.
