The AI Act Digital Omnibus Has Been Published in the Official Journal of the European Union

Regulation (EU) 2026/1744 of the European Parliament and of the Council on the simplifying of the implementation of harmonised rules on artificial intelligence (“Digital Omnibus on AI”) was published in the Official Journal of the European Union on 24 July 2026.

While the overall structure of the EU Artificial Intelligence Act (“AI Act”) remains unchanged, targeted amendments have been introduced to improve proportionality, simplify implementation and revise the application timeline of certain obligations.

In this regard, the key dates introduced or amended by the Regulation may be summarised as follows:

  • 2 August 2026: Most provisions of the AI Act, including the transparency obligations under Article 50 and the enforcement and sanctions framework, will become applicable.
  • 2 December 2026: The new prohibitions under Article 5 concerning non-consensual intimate material and child sexual abuse material will become applicable. This date will also constitute the deadline for compliance with the marking obligations under Article 50(2) for generative AI systems already placed on the market.
  • 2 August 2027: Delegated acts concerning the equivalence clause are expected to be adopted, national AI regulatory sandboxes will become operational and guidance on the interaction between the AI Act and EU harmonisation legislation will be issued by the European Commission.
  • 2 September 2027: Guidance on post-market monitoring will be issued by the European Commission.
  • 2 December 2027: High-risk AI systems falling within Article 6(2) and Annex III will become subject to the requirements set out under Chapter III, Sections 1 to 3.
  • 28 January 2028: Applications for designation as notified bodies may be submitted.
  • 2 August 2028: High-risk AI systems falling within Article 6(1) and Annex I will become subject to the requirements set out under Chapter III, Sections 1 to 3.
  • 2 August 2030: The transitional deadline applicable to certain AI systems intended to be used by public authorities will expire.

Following the publication of the Regulation, organisations should review their AI compliance roadmaps, internal governance structures and implementation schedules in accordance with the revised regulatory timeline.

The Regulation will enter into force on 27 July 2026.
