THE DECISION OF ECHR ON P.T. v. REPUBLIC OF MOLDOVA CASE

The European Court of Human Rights (“ECHR” or "Court") has come to a decision on P.T. v. the Republic of Moldova case no 1122/12.

In the case, the applicant needed military service book or an exemption certificate in order to keep living such as applying a job or obtaining a driving licence. In this context, he received an exemption certificate which disclosed its illness called HIV.

The ECHR examined the fact on the ground of article 8 subjected to respect for private life. According to the court, the fact that disclosure of personal medical data by the exemption certificate is sufficient to find a violation of Article 8. It is expressed that the manner in which personal medical data in an exemption certificate was protected from unnecessary disclosure was deficient. Because, it allowed third parties to find out the type of illness which is the reason of exempting from military service even if they have no intention to find out.
